The America Invents Act on ethics has a large impact on the malpractice of lawyers and attorneys. It discusses the effects of proper ethics that must govern the practice and keep the proceedings clean and morally right. The Office of Enrollment and Discipline (OED) carefully notes the instances of malpractice and is permitted to take disciplinary action against lawyers found to be deviating from the code of ethics.
Ethical malpractices include an attorney who is not authorized or licensed to present a case in a particular field practicing law. The State governments take direct action against gross misrepresentation of information, intentional misleading of witnesses, forced advertisements that deviate from the accepted norms. Lawyers have been held guilty and reprimanded publicly for misrepresentation and direct mailing of advertisements for foreclosure of defense and loan modification representation. The advertisements occasionally were found to contain misleading information, and it was also unclear how the addresses of the recipients were obtained. The content of the advertisements were also flouting rules, not submitting the content for scrutiny as required by law. These sectional violations will earn a public reprimand from the court.
